Terms and Conditions, effective 5\/17\/2001:
\nPlease review these guidelines that govern your account with Wave Networks LLC.<\/p>\n
1. The services (the “WVNT services”) provided to you by Wave\u00a0Networks, LLC. (“WVNT”) are subject to these Terms and Conditions. These Terms\u00a0and Conditions set forth the entire agreement between WVNT and you with
\nregard to the WVNT services. If any of these Terms and Conditions are\u00a0unacceptable to you, you may terminate your account as provided in\u00a0section 13 below. Your use of WVNT services shall be conclusively\u00a0deemed acceptance of these Terms and Conditions by you.<\/p>\n
2. YOU REPRESENT THAT YOU ARE AT LEAST EIGHTEEN (18) YEARS\u00a0OLD. You are fully responsible for how your account is used and all\u00a0activities conducted through your account. You may allow others to\u00a0occasionally use it, but you are fully responsible for what they do.<\/p>\n
3. You shall pay for the WVNT services according to the WVNT billing\u00a0policies then in effect. The WVNT billing policies are available at\u00a0www.wavenetworks.com. Payment will only be accepted in U.S. dollars. If WVNT\u00a0does not receive your payment when due, your account may be terminated.\u00a0Termination of your account does not remove your responsibility to pay
\nall fees incurred up to the date the account was canceled including any\u00a0attorney fees and collection fees incurred by WVNT to collect such payment.\u00a0You are responsible for providing all modems, telephone lines, personal\u00a0computer and other equipment necessary to use the WVNT service and for\u00a0payment of all telephone charges you incur in connecting to WVNT. If you
\nuse another organization’s networks or computing resources, you are subject\u00a0to their respective permission and usage policies. You agree to notify WVNT\u00a0of any changes in your account information, such as your address or\u00a0telephone number.<\/p>\n
4. ALL USE OF THE WVNT SERVICES AND THE INTERNET IS AT YOUR\u00a0SOLE RISK. THE WVNT SERVICES ARE PROVIDED ON AN “AS IS”,\u00a0“AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS\u00a0OR IMPLIED. You release WVNT from and WVNT shall have no liability\u00a0or responsibility for any direct, indirect, incidental or consequential
\ndamages suffered by you in connection with your use of or inability to\u00a0use the WVNT services including, but not limited to, loss of data from\u00a0delays, non-deliveries, mis-deliveries, or service interruptions even if\u00a0the same is caused by WVNT’s negligence. Without limiting the generality\u00a0of the foregoing, WVNT disclaims any responsibility for (and under no\u00a0circumstances shall be liable for) any conduct, content, goods and\u00a0services available on or through the Internet or the WVNT services. In\u00a0no event shall WVNT’s aggregate liability exceed the amount paid by\u00a0you to WVNT for the WVNT services. Some states do not allow the exclusion\u00a0or limitation of liability, and in such states WVNT’s liability is\u00a0limited to the full extent permitted by law. Use of any information\u00a0obtained via the WVNT service is at your own risk. WVNT shall have no\u00a0responsibility for the accuracy or quality of information obtained\u00a0through any WVNT services.<\/p>\n
5. WVNT’s services may only be used for lawful purposes. Reproduction or\u00a0transmission of any material in violation of any local, state, U.S., or\u00a0international law or regulation is prohibited. This includes, but it\u00a0not limited to: reproduction or transmission of copyright or\u00a0trademarked material without the permission of the owner, infringement\u00a0or repeat infringement of any copyright, trademark or other third party\u00a0intellectual property right, transmission of threatening, lewd,
\nlascivious, indecent or obscene material, transmission of material\u00a0protected by trade secret or using your account to make, create, solicit\u00a0or transmit any obscene or indecent material to or from any person under\u00a0eighteen (18) years of age. WVNT reserves the right, in its sole\u00a0discretion, to terminate your use of or access to WVNT’s services without\u00a0notice in the event of any violation of the policies contained in this\u00a0paragraph 5. Further, you shall defend, indemnify and hold harmless\u00a0WVNT from and against any claims, liabilities and expenses, including\u00a0attorneys fees, resulting from your use of the WVNT service or your account\u00a0in an unlawful manner or otherwise in violation of the Terms and\u00a0Conditions. At WVNT’s discretion, WVNT may revoke your access to WVNT\u00a0services or account for inappropriate usage.<\/p>\n
6. Use of any information obtained via the WVNT service is at your own\u00a0risk. WVNT shall have no responsibility for the accuracy or quality of\u00a0information obtained through any WVNT services.<\/p>\n
7. WVNT may list your e-mail information in relevant Internet directories,\u00a0such as InterNIC, WAIS, or X.500 series.<\/p>\n
8. These Terms and Conditions are subject to change by WVNT from time\u00a0to time effective ten(10) days after the new Terms and Conditions are\u00a0published by WVNT in www.wavenetworks.com. A current copy will also be\u00a0available from WVNT customer service. If any new Terms and Conditions are\u00a0unacceptable to you, you may terminate your account by giving written
\nnotice of termination to WVNT as provided in Section 13 below. Continued\u00a0usage of your account after new Terms and Conditions have gone into\u00a0effect constitutes acceptance of those new Terms and Conditions. We\u00a0encourage you to regularly check for Terms and Conditions updates.<\/p>\n
9. All use of WVNT services are subject to the specifications and\u00a0guidelines associated with that service. WVNT service specifications are\u00a0available at www.wavenetworks.com or can be obtained by contacting a Wave\u00a0Networks
\nservice representative.<\/p>\n
10. Any Network Address assignments issued by WVNT (i.e., Class C\u00a0address space) are the property of WVNT and are considered to be\u00a0“loaned”\u00a0to its customers. In the event service with WVNT is discontinued for any\u00a0reason, such addresses will revert to WVNT.<\/p>\n
11. All WVNT services are for end-user use only and may not be resold\u00a0to third parties without a separate reseller agreement on file with WVNT<\/p>\n
12. WVNT reserves the right to cancel the WVNT service at any time and\u00a0for any reason and to reimburse you any unused fees where appropriate\u00a0on a pro-rata basis.<\/p>\n
13. Some of the information available on WVNT systems, such as postings\u00a0in the UseNet newsgroups, is protected by copyright. Unless you have\u00a0permission from the copyright holder, you shall not redistribute this\u00a0information to others, including use of this information on radio,\u00a0television, or in printed media such as newspapers, magazines or\u00a0newsletters.<\/p>\n
14. Sending unsolicited mail messages, including, without limitation,\u00a0commercial advertising and informational announcements, is strictly\u00a0prohibited. A user shall not use another site’s mail server to relay\u00a0mail without the express permission of the site. Posting the same or\u00a0similar message to one or more newsgroups (excessive cross-posting or
\nmultiple-posting, also known as “spam”) is explicitly prohibited.<\/p>\n
15. You may cancel your account at any time upon prior written notice\u00a0to WVNT. You will still be responsible for any fees incurred up to the\u00a0date of termination of the services. WVNT will reimburse you for any\u00a0unused fees where appropriate on a pro-rata basis.<\/p>\n
16.
